This Terms of Service applies to the OnIt Video Tours website and to calls, text messages, and emails we exchange with you about an inquiry you make. In this Terms of Service, “OnIt Video Tours,” “we,” “us,” and “our” mean OnIt Video Tours, operated by [LEGAL ENTITY NAME TBC], 330 Mouse Corner Drive, Freehold, New Jersey. OnIt Video Tours is a service that turns real estate listing photos into captioned video tours with sound for real estate agents.

By using this website or submitting our form, you agree to these Terms of Service and to our Privacy Policy. If you do not agree, please do not use the website.

Using this website

You may use this website for lawful purposes to learn about OnIt Video Tours and to contact us. You agree not to misuse it, including by submitting false information or information about someone else without permission, sending spam, or trying to disrupt or gain unauthorized access to the site or our systems. You must be at least 18 years old to submit our form.

Signing up; nothing binding until you agree to the terms of an order

Submitting our form is a request for us to contact you. It does not guarantee that we will provide a quote, offer, or service, or that we serve your area. Any quote, price, or timeline we give you is an estimate based on the information available at the time and is not binding until it is set out in a written agreement signed by you and OnIt Video Tours. Website content is general information and may change without notice.

Video tour services

DRAFT NOTE. Pricing below is as decided but not yet in effect. The membership credit system (1, 2, or 4 credits per video) is a draft assumption for Alexander to confirm. The refund policy, turnaround times, billing date, and payment processor are still to be decided.

Free accounts, free sample videos, and first-video discounts

• Free account. Creating an account is free and requires your full name, email address, and phone number. It does not sign you up for a membership, and no payment is taken.
• Account required. A free account is required before you can receive a free sample video or a discounted first video.

• Eligibility. One account per person. We may decline or cancel an offer claimed more than once by the same agent or brokerage, or claimed with false or duplicate details. We may change or end these offers at any time before you claim them; a change does not affect an offer you have already claimed.
• Contact consent is not a condition. You do not have to agree to calls, texts, or emails to create an account, get a sample, get a discount, or buy anything.

Prices and membership

• Membership: $99 per month, which includes four (4) video credits each monthly billing period. A one-minute video uses 1 credit, a three-minute video uses 2 credits, and a five-minute video uses 4 credits. You can use your credits on one five-minute video, two three-minute videos, four one-minute videos, or any mix that adds up to four credits. • No rollover: membership credits are for the monthly billing period they are included in. Unused credits do not roll over and expire at the end of that period.
• Extra videos: videos beyond your monthly credits cost one minute, $39; three minutes, $99; five minutes, $149.
• Single videos for non-members: you do not need a membership to order. Non-members can buy single videos at the same prices.
• Payment: [PAYMENT PROCESSOR TBC]. We do not take payment through this website’s sign-up form. Before you are charged, we will show you the price and the membership terms and ask you to agree to them.
• Video lengths: Each video may run 1 or 2 seconds shorter than its advertised length (one minute, three minutes, or five minutes) for compatibility with third-party websites. A one-minute video is never longer than 59 seconds, a three-minute video never longer than 2:59, and a five-minute video never longer than 4:59. Every video is length-checked before delivery and is not delivered unless it is within its range: one-minute videos run 58-59 seconds, three-minute 2:58-2:59, five-minute 4:58-4:59.

Revisions, missed-error fixes, and paid edits

• Five free revisions. Each video includes up to five (5) free revisions for any changes you request. A revision is one round of changes you send us at the same time. We tell you how many free revisions you have left.
• Paid edits. Changes you request after your five free revisions are paid edits at $7.50 per minute of the video: $7.50 for a one-minute video (counted as one minute), $22.50 for a three-minute video, and $37.50 for a five-minute video. We will quote a paid edit and start it only after you agree.
• Full rebuilds. Rebuilding the whole video from scratch is priced as a new video at the per-video rate ($39, $99, or $149), or uses membership credits. [WHETHER A REBUILD INCLUDES NEW FREE REVISIONS TBC]
• Missed-error fixes. If, after delivery, you find an error our quality check missed (a visual glitch or AI artifact, a caption that does not match the scene, an element that is not in your photos, an audio problem, or a length error), we fix it free, up to two (2) missed-error fixes per video. Missed-error fixes never count against your five free revisions. Each missed-error fix beyond two on the same video is $7.50 per minute of the video.
• Quality check. Before delivery, every video is reviewed for visual errors and AI artifacts, caption-to-scene mismatches, added elements, audio problems, and length (no longer than 0:59, 2:59, or 4:59 for one-, three-, and five-minute videos). We fix any errors we find and check the video again before delivering it. Fixes made during our own quality check are always free and are not counted as revisions or missed-error fixes. Every revision, fix, and paid edit is quality-checked again before redelivery.
• A change that adds something not in your photos cannot be made, free or paid (see “Real photos only” below).

Your photos and listing information

• You confirm you have the rights. By sending us a listing URL, photos, or other materials, you confirm that you own them or have permission (for example, from your brokerage, your photographer, or the seller) to use them and to let us create videos from them, and that using them for this purpose does not break any MLS rule, license, or agreement.
• You give OnIt Video Tours permission to use those materials only to make, revise, and deliver your videos. [OWNERSHIP OF FINISHED VIDEOS AND ANY USE AS SAMPLES TBC]
• You agree to tell us right away if your rights to any photo change, for example if the listing expires or a photographer withdraws permission.

Real photos only

We create each video using your photos exactly as they appear. We do not add trees, bushes, kitchen islands, furniture, decor, props, or any other element that is not in the photos, and we do not change the property’s rooms, finishes, or features. We add only AI-generated people, captions, voiceover, and background audio, and each scene is made to match its caption. Please review every video before you use it and tell us about anything that does not match your photos; fixing it is covered by our missed-error policy above. [ATTORNEY TO CONFIRM]

AI-generated videos

Our videos are AI-generated. Even with our quality checks, a video may occasionally contain an error or need a revision. That is why each video includes five free revisions and up to two free missed-error fixes, as described above.

AI-generated people

The people shown in our videos are AI-generated and are not real people, residents, sellers, or buyers. Each video includes a label saying so, and you agree not to remove it or to present the people as real. People in our videos are shown to help viewers picture the space and do not indicate who lives, or should live, in the home.

Your advertising responsibilities

You are responsible for how you use and publish each video, including following your MLS’s rules, your brokerage’s policies, real estate advertising rules (including brokerage identification and New Jersey Real Estate Commission rules), and fair housing laws. Captions and voiceovers are based on the information you give us; please check them for accuracy before publishing.

Refunds and cancellations

Communications program terms (calls, AI voice, texts, and email)

Our forms have three separate, optional boxes, one each for calls, text messages, and email, and each starts unchecked. For each box you check (or if you otherwise agree), you join the OnIt Video Tours Client Updates communications program for that channel only, and agree that OnIt Video Tours may contact you at the phone number or email address you provided about your account, free sample, offers, and video orders (such as confirming your sign-up, sending your script and captions draft for approval, delivery notices, and revision updates), including with AI-generated calls, texts, and emails, by:

• Calls, including calls made or answered by an AI voice assistant, prerecorded or artificial voice messages, and calls placed using automated technology. Calls may be recorded and transcribed.
• Text messages, which may be sent using automated technology.
• Email.

Your consent is not a condition of creating an account, getting a free sample or a discount, or any purchase or service, and you can request our services without giving it. Every call, text, and email includes a clear way to opt out (see below and our opt-out page). You confirm that the phone number and email you provide are yours or that you are authorized to use them.

Text messages

• Message frequency varies (up to [X] messages per week) based on your inquiry.
• Msg & data rates may apply.
• Reply STOP to cancel at any time. You will receive one confirmation message and no further texts. Reply HELP for help, or email admin@onitoffers.com.
• Carriers are not liable for delayed or undelivered messages.
• We do not share, sell, or rent your mobile phone number or text opt-in consent with third parties or affiliates for marketing purposes. See our Privacy Policy.

Calls and AI voice

Our AI voice assistant identifies itself as an AI and will say so if you ask. Calls may be recorded. You can tell us during any call that you do not want to be called again, and we will add your number to our internal do-not-call list.

Email

• Unsubscribe: every marketing email includes a working unsubscribe link. We honor unsubscribe requests within 10 business days and do not charge a fee or ask for more than your email address to process them.
• Honest emails: our emails do not use false or misleading header information (such as the “From” name or reply address) or deceptive subject lines, and marketing emails are identified as advertisements where the law requires.
• Our address: every marketing email includes our valid physical postal address: [BUSINESS POSTAL ADDRESS TBC — currently 330 Mouse Corner Drive, Freehold, New Jersey; confirm Mouse vs Mounts, unit, and ZIP].
• We may still send transactional or relationship emails about a request or job you have with us.

Revoking consent

You may revoke consent at any time, by any reasonable means: reply STOP to a text, use the unsubscribe link in an email, tell us during a call, or email admin@onitoffers.com. Revoking consent for one channel does not affect your requests on other channels unless you say so; tell us if you want all communications to stop.

Intellectual property

The website and its content, including the OnIt Video Tours name, logos, text, graphics, and design, belong to OnIt Video Tours or its licensors and are protected by law. You may view and print pages for your personal, non-commercial use. You may not copy, modify, or reuse our content or marks without our written permission.

Disclaimers

The website and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the website will be uninterrupted, error-free, or free of harmful components. Any warranty for work or services will be stated only in your written agreement.

Limitation of liability

To the fullest extent permitted by law, OnIt Video Tours and [LEGAL ENTITY NAME TBC] will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or opportunities, arising from your use of the website or these Terms. Our total liability arising from your use of the website will not exceed one hundred U.S. dollars ($100). Some laws do not allow certain limitations, so some of these may not apply to you. Nothing in these Terms limits rights you have under New Jersey consumer protection law that cannot be waived.

Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New Jersey, unless applicable law requires otherwise.

Changes to these Terms

We may update these Terms from time to time by posting a new version on this page and changing the effective date above. Your continued use of the website after a change means you accept the updated Terms.
